Terms & Conditions

  • RESERVATIONS
    The contract of short stay holiday letting is between the Guest and the Proprietor of Joseph Apartment, The Square, Buxton.

    All rents include VAT. We reserve the right to change tariffs after publication should this be considered necessary. Any such changes will be made clear prior to the booking being accepted.

  • INITIAL DEPOSIT PAYMENT
    The initial deposit payment shall be 1/3rd of the Rental Price. (Minimum: £100)

  • BOOKINGS WITHIN 8 WEEKS OF START DATE
    For holidays booked within 8 weeks of the start date of the holiday then the full Rental Price is due on booking.

  • BOOKING FORM AND PAYMENT
    Please use the Booking Form and make your payment as follows:

    Payments can be made by cheque (Payable to The Square - accompanied by a valid cheque guarantee card or debit card) or BACS (Our preferred option) or pay using a debit or credit card (Via paypal on the internet).

    We incur a 2% credit card company handling charge when payments are made by credit cards and reserve the right to recover these costs which will be advised at the time of payment. There is no extra charge for cheques, BACS or Debit Cards (Switch / Maestro / Delta / Connect / Solo or other)

    INTERNATIONAL Payments may be made by bank transfer to:

    Barclays Bank, Buxton

    Please note there will be an additional charge of £7 to cover the bank charge for currency conversion. Please quote your booking reference to the bank and you must notify us of the amount which is being paid in, the name of the bank and the date the transaction was authorised. (Please contact us for further details).

    Please read our terms and conditions carefully as you are entering into an agreement with The Square once you forward the signed booking form & deposit to us.

  • CONFIRMATION OF BOOKING
    Once in receipt of payment and booking form you are bound by these conditions and confirmation of your booking will be posted or e-mailed to you by return.

  • BALANCE
    The balance of payment is due 8 weeks prior to the start of your holiday. For payment by credit card please add 2% to cover the Credit Card Company costs. There is no extra charge for cheques, BACS or Debit Cards (Switch / Maestro / Delta / Connect or other). We reserve the right to cancel any booking if payment of the balance is more than 14 days late.

  • CANCELLATION BY YOU
    Deposit: Please note that your deposit is non refundable.

    Balance:

    If you or any of your group are unable to take the holiday or part of the holiday and cancel within 8 weeks of the start date (For whatever reason including illness), unfortunately, a cancellation charge will be levied if we are unable to re-let the holiday.

    For any part of the cancelled visit that is not re- let a charge will be levied which you are obliged to pay even if you cancel and don't come. (We will keep your card details on file for all partly paid bookings and will deduct the balance owing when it becomes overdue).

    The cancellation charge is based upon the number of days notice prior to the arrival date as follows:

    Up to 21 days – 100%, 22 – 42 days – 75%, 43 – 56 days – 50%

    We will always do our best to re-let the dates and if we do so, we would not expect you to pay the balance due. We will refund you the monies received from the replacement letting (Less a £10 administration fee, if payment of the balance has already been made).

    If you are planning to cancel your holiday, please inform us by phone & confirm in writing (By email or recorded delivery - enclosing a copy of your Booking Confirmation) as soon as possible.

    You may be able to claim some of your money back from your holiday cancellation insurance

  • CANCELLATION PROTECTION INSURANCE
    Cancellation Insurance is strongly recommended at the time of booking to protect you against liability to pay the full hire if forced to cancel the holiday due to reasons such as death, injury, maternity complications, or illness of yourselves, a close relative or business associate.   • CANCELLATION BY US
    In the unlikely event of Joseph Aprtment no longer being able to accept the booking following confirmation (As a result of extraordinary circumstances e.g. damage to the property) we may be forced to cancel the booking. Should this happen, we will offer you a full refund or, if you wish, attempt to find alternative accommodation.

    Our liability would not extend beyond this refund. We will not be liable for any other losses/damages, etc. suffered by you as a result of the property being unavailable on the day stated.

  • ALTERATION OF BOOKINGS
    Whenever possible Guests who wish to change a booking once the Confirmation of Booking has been sent out will be charged a fee of £10.

  • ARRIVAL AND DEPARTURE
    Letting is from Saturday to Saturday unless otherwise stated or arranged with ourselves. Guests have access to the accommodation from 4.00pm onwards on the day of arrival and are requested to leave by 10.00am on the day of departure. Please advise ourselves at least 48hours before arrival of your anticipated arrival time at which point arrangements will be made for key collection. Keys are to be left in the entrance hall key box on departure.

  • LIABILITY
    A maximum of ten adults only is permitted to hire and/or use the facilities of the property. The property is only for the period of time agreed by the proprietor and the guest and must not be sub-let or used as a base for meeting or entertaining other people including friends and family for any reason.

    No liability shall be accepted by the proprietor for loss, damage or theft of personal property belonging to guests, either in the property or in/to cars, bicycles or other vehicles left at the property. Nor shall liability be accepted by the owners for accident or injury to guests, either within the property or outside.

    The Guests rights to occupy the property may be forfeited without compensation if:

    • More people than specified in our description, or as stated on the Confirmation of Booking, attempt to occupy the property.
    • Overnight guests are entertained without the Owners permission.
    • The Guests cause damage, noise, unreasonable disturbance or conduct.


  • UNSUITABLE HIRERS
    We reserve the right to decline a booking or refuse to hand over the keys to any persons where in our opinion the facilities are not suitable for the person or any group member. In such cases all sums paid shall be refunded in full and the contract shall be discharged without further liability on either party. We reserve the right to repossess the property at any time where damage has been caused by any member of your party or in our opinion is likely to be caused by you or any member of your party. In such cases we shall not be liable to make a refund of any portion of the hire terms paid.

  • RETURNABLE GOOD HOUSEKEEPING / PARKING PERMIT DEPOSIT.
    Guest’s will be requested to furnish ourselves on arrival, or previously by post in some instances, a RETURNABLE bond in the form of a £250 cheque endorsed with a Bankers Card number. The cheque will not be cashed without first consulting the guest and in the absence of a claim will be either cancelled or returned after the holidays.

  • GUEST RESPONSIBILITY
    We ask that guests are responsible and take care of the accommodation and its contents and the accommodation and all equipment is left in a clean and tidy condition.

    Please ensure the doors are securely locked, windows are shut and lights are turned off when leaving the accommodation. Also ensure that electrical appliances are not left unattended.

    We appreciate that accidents do happen and we accept any minor breakages. However, we reserve the right to charge for any major damage or breakage.

    Missing or broken items, replacements or repairs must be reported without delay, not at the end of the holiday, so that immediate correction can be made and disputes over who caused the damage can be eliminated. Any payment for breakages, damage, extra cleaning etc. must be adequately compensated.

    The person who made the booking is responsible for such payments and the debit/credit card details submitted at the time of booking will be charged accordingly.

  • ACCESS
    The proprietors (or representative) of Joseph Apartment shall be allowed access to the accommodation at any reasonable time with prior notice given wherever possible for the purpose of emergency repair or any other need.

  • COMPLAINTS and FAULTS
    In the event of a complaint or if you find that anything is faulty within the accommodation that needs our attention, the matter should always be taken up with ourselves as soon as possible, so that we can assist and repair or make alternative arrangements.

  • BED LINEN AND TOWELS
    All bed linen (Except for cots), duvets, pillows, bath towels and tea towels are included in the rental price.

  • GAS AND ELECTRICITY
    Gas central heating, electricity and hot water is included in the rental price. We ask that appliances are turned off when not in use and that lights are turned off when the property is unattended.

  • COTS
    If a cot is required, please check with us, as to its suitability.

  • SMOKING AND PETS
    To maintain high standards and in the interests of fire prevention, the accommodation is non smoking and animals are not permitted.

    Unfortunately, a booking would be terminated immediately if any of the party were found to have smoked within the property or if an animal was allowed access into the property.

    The person who signed the booking form may be liable for the costs of professional cleaning and no refund would be made for early departure.
